Terms of Service

By creating an account or using Vibe Check (the “Service”), operated by Stowe Stats (“we,” “us”), you agree to these Terms. If you don’t agree, don’t use the Service.

1. What Vibe Check is

Vibe Check is a personal journaling and self-reflection tool aimed at traders. It helps you log readiness, plans, and post-session reviews, and shows you your own history. It is not financial, investment, trading, tax, or legal advice. See the Disclaimer for the full picture.

2. Your account

You’re responsible for keeping your password secure and for everything that happens on your account. You must be at least 18 to use the Service. One account per person; don’t share logins.

3. Acceptable use

Don’t use the Service to:

• Break the law or anyone’s rights.
• Upload content that’s illegal, abusive, infringing, or someone else’s confidential information.
• Try to break, probe, scrape, reverse-engineer, or overload the Service.
• Use the Service to provide financial advice to others, or to pretend you’re affiliated with us when you’re not.
• Resell, sublicense, or repackage the Service.

4. Your content

Everything you enter belongs to you. We don’t claim ownership of your check-ins, plans, reviews, screenshots, or notes. You grant us a limited license to store, process, and display your content back to you so the Service can work. We don’t sell your content or share your individual entries with anyone. The one exception: we may use combined, anonymized data across many users — in a form that cannot reasonably be linked back to you — to improve the Service, study patterns in trader psychology and performance, and share aggregate insights publicly, as described in our Privacy Policy.

5. Our content

The Service itself — the design, code, brand, copy, video walkthroughs, badges, and Vibe Check name — belongs to Stowe Stats. Don’t copy or redistribute it without permission.

6. Affiliate links

We may use affiliate links and codes. If you sign up through one, we may earn a commission, and the price to you doesn’t change. Our current affiliate partners include Lucid Trading, My Funded Futures, and Tradeify, each using the code VIBE. A legacy Lucid Trading code (“STOWE”) may still be active; we no longer promote it, but we may still earn a commission if it is used. See the Disclaimer for more.

7. Service availability

We try to keep Vibe Check running well, but we can’t guarantee uptime, reliability, or that the Service will be available in any particular form. We may add, change, or remove features, pause access, or discontinue the Service at any time, with or without notice. If we shut the Service down, we’ll make a reasonable effort to let you export your data first.

8. No warranty

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, secure, or that any data, scores, or visualizations it produces are reliable enough to base trading or financial decisions on.

9. Limitation of liability

To the maximum extent permitted by law, Stowe Stats and its operators are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, trades, or opportunity, arising out of or in connection with your use of the Service — whether based on warranty, contract, tort, or any other legal theory, even if we’ve been advised of the possibility.

Our total liability for any claim arising out of or relating to the Service, for any reason, is limited to one hundred U.S. dollars (US $100). Some jurisdictions don’t allow these limits, so they may not fully apply to you.

10. Indemnification

You agree to defend, indemnify, and hold Stowe Stats harmless from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of: your use of the Service, your content, your breach of these Terms, or your violation of any law or third-party right.

11. Account termination

You can delete your account anytime from Settings → Danger Zone. We may suspend or terminate accounts that violate these Terms, abuse the Service, or pose a risk to other users or to us. We’ll try to give notice where reasonable, but we’re not required to.

12. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved exclusively in the state or federal courts located in Beaver County, Pennsylvania, and you consent to personal jurisdiction there.

13. Changes to these Terms

We may update these Terms. If we make material changes, we’ll update the “Last updated” date and, where appropriate, ask you to re-accept. Continuing to use the Service after a change means you accept the new Terms.

14. Miscellaneous

If any part of these Terms is found unenforceable, the rest still applies. Our not enforcing a right at one time isn’t a waiver of that right. These Terms are the full agreement between you and us about the Service.
